LEGAL TERMS FOR THE ONLINE PURCHASE OF TICKETS VIA THE WEBSITE www.realbetisbalompie.es

The following conditions of sale are intended to set out the terms and explain the details of the operation for the purchase of tickets by users who proceed to acquire them through this channel, as well as the rights and obligations inherent to the ticket(s) being purchased.

1. GENERAL FEATURES

REAL BETIS BALOMPIÉ (hereinafter, “REAL BETIS” or the “SELLER”) offers its members, fans and followers, as well as any other interested person, the possibility of purchasing tickets via the Internet to attend matches and/or sporting events in which the teams of the different sections integrated into REAL BETIS participate. Internet users who access the REAL BETIS website and, specifically, this ticket sales section, voluntarily assume and undertake to respect the terms and conditions of the sales contract to which they are subject and which are set out below.

2. FORMALIZATION OF THE SALE

From the moment the user places the purchase order for one or more tickets, they shall be referred to as the “PURCHASER” and shall be bound as such to REAL BETIS, which shall have the status of “SELLER.” The purchase made via the Internet by the PURCHASER and received by REAL BETIS has a binding contractual nature. The PURCHASER must correctly and fully complete the required data and undertakes not to enter false information. Receipt of the purchase order will be confirmed by email, and from that moment the sale and purchase shall be perfected and both parties shall be obligated to perform as agreed.

3. GENERAL CONDITIONS GOVERNING THE PURCHASE OF TICKETS THROUGH THIS SITE

Acquisition of the ticket(s) constitutes acceptance by the PURCHASER of the following General Conditions:

• A) The PURCHASER acknowledges that REAL BETIS applies a dynamic pricing policy, which means that the originally established price of the product or service may increase or decrease depending on supply and demand and the temporal proximity of the specific event. The PURCHASER pays the price published on the website at the time the purchase is completed, but the price of similar tickets may rise or fall (for future purchases by third parties) after the PURCHASER has made their purchase. The PURCHASER shall not be entitled to any refund of the price difference if the price of similar tickets subsequently decreases after the purchase. Therefore, the validity of the ticket(s) and the price thereof shall be those shown on the website/app at the time of purchase. The price printed on the ticket(s) usually corresponds to its face value and not necessarily the purchase price. The PURCHASER shall not be entitled to a refund on the grounds of having paid a price higher than the face value.

• B) The date and time of the match for which the ticket(s) are purchased, and the price thereof, shall be those shown on the website or in the application at the time of purchase. Considering that the date and time of the match may be modified unilaterally by the competition organizer, the PURCHASER acknowledges and accepts that they are solely responsible for verifying the final date and time of the match prior to its taking place. This verification may be carried out via the REAL BETIS website and the APP.

• C) REAL BETIS is subject to restrictive security regulations applicable to the organization of and access to sporting events, and it is therefore expressly stated that all tickets available to the PURCHASER on the REAL BETIS website and APP are intended exclusively for purchase by REAL BETIS supporters, as is expressly indicated on the website and the APP throughout the purchasing process. Consequently, acquisition of tickets by supporters of rival teams may be considered a fraudulently made purchase.
  
  On an exceptional basis, REAL BETIS may block the purchase of tickets from certain countries, specifically when those purchases are made from the countries of the teams that are rivals of REAL BETIS for the specific sporting event for which tickets are offered for sale. This prohibition is implemented in compliance with Regulation (EU) 2018/302 of the European Parliament, since REAL BETIS must ensure the proper segregation of fan bases to comply with Law 19/2007 of 11 July against violence, racism, xenophobia and intolerance in sport, and its implementing regulations—essential rules for the staging of sporting events in Spain. Therefore, and in compliance with the provisions of the European Regulation, REAL BETIS will block any transfer of tickets carried out in this way insofar as such blocking is necessary to ensure compliance with the aforementioned regulations.
  
  The number of tickets, their price and their location shall be chosen by the PURCHASER during the purchase process and may not be modified once finalized.

• D) The purchase of tickets through the official REAL BETIS website offers a print-at-home service, which allows the PURCHASER to (i) print the ticket at the moment of completing the purchase process (by downloading a PDF file) or (ii) save the file on their computer for later printing. In exceptional situations, for technical and/or security reasons, the print-at-home service may be disabled, in which case the PURCHASER must go to the Club’s ticket office at least 2 hours before the match to collect the ticket(s). To collect the tickets, the PURCHASER must present at the ticket office: the credit/debit card used for the purchase and the ID/passport of the holder of such card. If collection is carried out by a third party different from the PURCHASER, that person must present the credit/debit card used for the purchase, the original ID of the PURCHASER, and a signed authorization from the PURCHASER authorizing that third party to collect the ticket, in addition to the original ID or passport of the third party collecting the ticket.

• E) No exchanges or refunds of tickets will be accepted, except in the event of cancellation or suspension of the event (see Section 3.F). In this regard, the PURCHASER (even if a consumer of the European Union, Norway, Liechtenstein or Iceland) may not exercise the right of withdrawal or termination provided in both Directive 2011/83/EU and Article 103 of Law 3/2014 of 27 March, amending the recast text of the General Law for the Protection of Consumers and Users and other complementary laws, approved by Royal Legislative Decree 1/2007 of 16 November, as the exercise of such right is excluded in these cases.
  
  The PURCHASER must ensure, before completing the ticket purchase process, the accuracy and suitability of the data entered. The PURCHASER’s inability to attend the event and/or an error in making the purchase shall not be valid grounds for requesting a refund of the ticket price. In accordance with the applicable consumer and retail trade regulations, the PURCHASER may not exercise the right of withdrawal or termination since the provision of services related to leisure activities is exempt from such right.

• F) Once the ticket(s) have been purchased, they shall only be exchanged or refunded in the event of cancellation of the event prior to the start of the match, in which case the PURCHASER may request a refund within the following 48 hours and REAL BETIS undertakes to process it as soon as possible and within a maximum period of 15 days, in the manner specified by the Club, and in all cases upon presentation of proof of purchase. Once the match has started, if it is suspended due to force majeure, the price of the seat will not be refunded. In any case of refund, the Club will refund only the ticket price and shall not be responsible for any other expense or cost, such as, by way of example and not limitation, hotels, travel, meals, allowances, etc.

• G) REAL BETIS reserves the right to alter or modify the times, programs or teams announced for the relevant match, as well as to decree the suspension of the event.

• H) REAL BETIS offers different types of discounts and promotions for ticket purchases throughout the season through its website, APP, social media profiles and/or any other official Club communication channel. Promotions and/or discounts shall in all cases be subject to the particular conditions indicated in each of them and are under no circumstances cumulative. In addition to any discount and/or promotion, the ticket purchase terms and conditions described in these legal conditions shall apply.

4. PRICES AND FEES

The ticket price indicated on the Website or in the App includes VAT and will be the price shown on the order page of the Website or the App at the time of purchase. The price of a ticket may increase or decrease over time as set out in Section 3.A of these conditions, but the price payable will always be the price displayed when the purchase is completed.

We make every effort to ensure that ticket prices shown on both the Website and the App are correct. If we discover an error in the price of your order, we will contact you to give you the option to reconfirm your order, correct the price, or cancel your order. We will issue any refund via the payment method used to place the order, as appropriate. If we are unable to contact you, you agree that we may treat your order as canceled.

5. SPECIAL CONDITIONS FOR PURCHASING TICKETS WITHOUT SEAT SELECTION

The following conditions apply, in addition to the General Conditions in Section 3 above, only where the PURCHASER buys one or more tickets (up to a maximum of 6) without seat selection. In the event of any contradiction or inconsistency between the General Conditions and these Special Conditions, the latter shall prevail when purchasing tickets without seat selection.

In the “tickets without seat selection” modality, the PURCHASER chooses one of the available Stadium zones, but REAL BETIS selects and assigns the specific rows and seats, notifying the PURCHASER via email or through the APP of the final seat(s) with a minimum of forty-eight (48) hours prior to the start of the match.

If, due to availability reasons, the Club is unable to assign the PURCHASER seats in the Stadium zone chosen by the PURCHASER during the purchase process for tickets without seat selection, the PURCHASER shall be entitled to an upgrade, such that all seats finally assigned to the PURCHASER by the Club will be located in a zone with a higher price than the one initially selected by the PURCHASER. Notwithstanding the foregoing, the PURCHASER shall have a period of twenty-four (24) hours from the communication offering the different seat location to decline such upgrade and obtain a refund of the amount corresponding to the “tickets without seat selection” subject to the improvement. After said period, the PURCHASER shall not be entitled to a refund of such amount.

6. CONDITIONS OF ACCESS TO AND STAY IN THE REAL BETIS BALOMPIÉ FACILITIES

• A) REAL BETIS always reserves the right of admission. The minimum legal age to access this type of event is 16 years. Any minor under this age must be accompanied by a responsible adult.

• B) For security reasons, at the time of accessing the venue, attendees may be searched, and in no case will the entry of objects that may be considered dangerous or that are prohibited by current safety regulations for sporting events be permitted. The following behaviors are strictly prohibited and will therefore legitimize refusal of access:
  
  - Bringing in alcoholic beverages, weapons, instruments that may be used as such, flares, fireworks or similar objects.
  
  - Bringing in and displaying banners, symbols, emblems or slogans that incite violence.
  
  - The bearer having been sanctioned with a ban on access to any sports venue, for as long as the sanction remains in force.
  
  - Being under the influence of alcoholic beverages, narcotics, psychotropic substances, stimulants or similar substances.

• C) REAL BETIS may deny access to or expel the bearer of the ticket from the venue in the event of non-compliance with these conditions or in the event of failure to follow instructions given by Club staff. Refusal of access or expulsion may also be carried out if it can reasonably be foreseen that the person’s remaining in the venue would pose a risk or danger to the bearer themself or to other attendees at the event. In all cases the bearer shall be personally liable for their own actions and omissions when these cause injury to third parties or damage to property.
  
  In any case, access and stay will be denied where the conditions of access and stay set out in Law 19/2007 of 11 July against violence, racism and xenophobia are not met.

• D) Any attempt at fraud, theft, robbery, as well as damage to private property caused directly or indirectly in the REAL BETIS facilities, will entitle the Club to take measures and initiate legal actions it deems appropriate against the perpetrators.

• E) The ID number (DNI) of one of the attendees to the match will be printed on the tickets, and stadium security may require identification to guarantee access.

• F) The use of professional photographic or recording equipment within REAL BETIS facilities is prohibited unless expressly and in writing authorized in advance by REAL BETIS. Laser pointers and animals are also prohibited, except for guide dogs.

7. USE OF THE TICKETS PURCHASED

• A) Tickets purchased to attend sporting events at REAL BETIS facilities contain various security features to preserve their validity and authenticity. REAL BETIS is not responsible for tickets that have not been purchased at official points of sale or through authorized agents and/or those that have not been printed directly by the PURCHASER through this site. Any ticket that is damaged, torn or shows signs of falsification will entitle REAL BETIS to prevent its bearer from accessing the venue. In the case of forgeries, REAL BETIS reserves the right to take appropriate legal measures. Tickets acquired through this channel must be safeguarded by the PURCHASER until the day of the event. The ticket purchaser or the person in whose name the ticket is personalized assumes all responsibility in the event of duplication, photocopying or forgery, losing all rights that the ticket grants for access to the venue.

• B) REAL BETIS is not responsible for any loss or theft of tickets, nor for any personal belongings.

• C) The illegal resale (or attempted illegal resale) of a ticket constitutes grounds for confiscation or cancellation of such ticket without refund or any other type of compensation. Likewise, if the PURCHASER is a REAL BETIS season ticket holder, the Club reserves the right to cancel the season ticket. In order to prevent illegal resale, the number of tickets that can be purchased may be limited by setting a maximum per person or member and/or per credit card. Purchases made in contravention of the criteria established by REAL BETIS and communicated on the site will entitle the Club to cancel such tickets, in which case the buyer must be duly notified.

• D) The purchase of tickets does not authorize the PURCHASER to use the tickets, or their content, for advertising, marketing or promotional purposes (including contests, gifts and/or raffles), unless with the express prior written consent of REAL BETIS. Failure to comply with this prohibition will entitle REAL BETIS to void the ticket(s) and to initiate any legal action it deems appropriate to claim damages that such conduct may have caused to REAL BETIS.

8. PERSONAL DATA, IMAGE RIGHTS AND INTELLECTUAL PROPERTY

REAL BETIS will process your data to properly execute your purchase, as well as to comply with invoicing obligations and corresponding tax obligations. Such data are necessary for the execution of the purchase and the management of the contractual relationship.

The Club reserves all image rights and intellectual property rights in the event. The PURCHASER shall not transmit, distribute or sell (or assist in doing so) any description, notation, image, video, audio, data, statistics and/or any other form of reproduction of the event, except for personal and private use, and breach of any of these obligations shall likewise constitute grounds to prevent the bearer from remaining in the sports venue, without prejudice to any legal actions that may be brought against the infringer.

The ticket holder acknowledges that they may appear in images taken at the facilities by different means for subsequent informational or promotional dissemination, and authorizes such use.

If there are video surveillance cameras on the premises, REAL BETIS informs the PURCHASER that their image will become part of a file under the responsibility of the organizer for the purpose of access control and event security, as well as the resolution of any incident. The PURCHASER may exercise their rights of access, rectification, erasure, objection, restriction or portability in accordance with the provisions of the Privacy Policy.

9. APPLICABLE LAW AND JURISDICTION

The sale and purchase of tickets carried out through this site is governed by Andalusian law and, subsidiarily, in all matters not regulated, by Spanish law. For any disputes that may arise in the performance of the sale and purchase, the parties submit to the jurisdiction of the Courts and Tribunals of the city of Seville, waiving any other jurisdiction that may apply.
